JOBHOUND — Terms of Use

The Esports Network Limited (company registration number C102035), a company incorporated in Malta with its registered office at Eden Place, St. Augustine Street, St George's Bay, St Julian's STJ 3310, Malta, trading under the brand name Jobhound ("we", "us", "our"), operates the Jobhound online job board accessible at jobhound.mt and via any associated mobile applications (collectively, "the Platform").

IMPORTANT — PLEASE READ CAREFULLY

These Terms of Use ("Terms") form a legally binding agreement between you and The Esports Network Limited. By accessing or using the Platform in any way, you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree, you must not use the Platform.

If you are accepting on behalf of a company or other legal entity, you confirm you have authority to bind that entity.

1. Definitions

In these Terms the following words have the meanings set out below. Defined terms appear capitalised throughout.

"Account" means a registered user account on the Platform, held by a natural person, through which the user may access Platform features as a Job Seeker, an Employer team member, or both. There is no separate "employer account" or "job seeker account" — all users hold a single Account.

"AI Features" means Platform functionality that uses artificial intelligence, including AI-Assisted Application Review (Section 8.3) and AI-based vacancy recommendations and smart job alerts for Job Seekers (Section 5.7).

"ATS (Applicant Tracking System)" means the candidate management functionality of the Platform that allows Employers to receive, organise, evaluate, and communicate with Applicants.

"Applicant" means a Job Seeker who has submitted a Job Application to a specific Job Vacancy.

"Application Data" means all personal and professional information submitted by an Applicant as part of a Job Application, including profile data, CV or résumé, cover letter, screening question responses, and any attached files.

"Candidate Profile" means an optional profile, separate from the Account, through which a Job Seeker may make themselves discoverable to Employers on the Platform.

"Company Profile" means the employer-facing presence on the Platform, created and maintained by a user acting as an Employer, containing information about the company and its active Job Vacancies.

"Content" means any text, images, files, data, links, or other material posted, uploaded, submitted, or transmitted via the Platform by any user.

"Employer" means any user whose Account is associated with one or more Company Profiles, either as the creator of a Company Profile or as an invited team member. A user does not register separately as an Employer; Employer status arises automatically upon creation of or addition to a Company Profile.

"Job Application" means a formal expression of interest submitted by a Job Seeker in response to a Job Vacancy.

"Job Seeker" means a user who uses the Platform to search for employment opportunities and submit Job Applications. A user may be both a Job Seeker and an Employer under the same Account.

"Job Vacancy" means a job listing published on the Platform by an Employer (also referred to on the Platform as a "Job Post").

"Paid Services" means any feature, subscription plan, posting credits (referred to on the Platform as "Job Post Credits"), promotional feature, or advertising product offered by Jobhound for a fee.

"Platform" means the Jobhound website at jobhound.mt, any associated sub-domains, APIs, mobile applications, and related services.

"Terms" means these Terms of Use, as amended from time to time.

2. Acceptance of Terms

2.1 By creating an Account or using the Platform, you enter into a binding agreement with The Esports Network Limited on the basis of these Terms.

2.2 If your Account is associated with a Company Profile, you confirm: (a) you act in the course of a business; (b) where applicable, you have authority to bind the company to these Terms; and (c) the company accepts these Terms in full.

2.3 These Terms apply to all users of the Platform, including Job Seekers, Employers, and visitors who browse without registering.

3. The Platform

3.1 Jobhound is an online job board that connects Job Seekers with Employers primarily in Malta. The Platform provides:

  • a searchable database of Job Vacancies posted by Employers;
  • tools for Job Seekers to create an Account, build a Candidate Profile, and submit Job Applications;
  • an ATS enabling Employers to receive, review, and manage Job Applications, including AI-Assisted Application Review (Section 8.3);
  • tools for Employers to create and manage a Company Profile and post Job Vacancies; and
  • Paid Services to enhance the visibility and reach of Employers and their Job Vacancies.

3.2 Jobhound is a job board — it is not a recruitment or staffing agency, does not employ any person on behalf of any Employer, and is not party to any employment, contractor, or other arrangement between a Job Seeker and an Employer. Jobhound does not guarantee any employment or hiring outcome for any user.

3.3 The Platform may contain advertising or sponsored content. We will identify such content where required by applicable law.

3.4 We reserve the right to modify, suspend, or discontinue any feature of the Platform at any time without liability, provided that where Paid Services are materially affected we will make reasonable efforts to notify affected Employers.

4. User Accounts

4.1 Registration

4.1.1 To access the full functionality of the Platform, you must register and create an Account. Registration is available via: (a) email address and password; (b) Google (OAuth); (c) LinkedIn (OAuth); or (d) Facebook (OAuth).

4.1.2 By registering via a third-party OAuth provider, you authorise us to receive and use the profile information made available by that provider in accordance with these Terms and our Privacy Policy.

4.1.3 A single Account may be used in both Job Seeker and Employer capacities simultaneously. Where an Account is added as a team member of a Company Profile, certain Job Seeker-facing interface elements may be replaced by Employer-facing functionality for user experience purposes; this does not affect the underlying rights of the Account holder.

4.2 Minimum Age

4.2.1 The Platform is not intended for persons under 16. By registering you confirm you are at least 16 years of age.

4.2.2 Date of birth may be provided voluntarily in Account settings at any time, or will be collected at a user's first Job Application if not previously provided. The minimum selectable age is 16. We rely on this self-declaration and are not able to technically verify age at registration.

4.2.3 If we become aware an Account holder is under 16, we reserve the right to suspend or delete that Account without notice.

4.3 Account Security

4.3.1 You are responsible for maintaining the confidentiality of your login credentials and all activity that occurs under your Account.

4.3.2 Notify us immediately at [email protected] if you become aware of any unauthorised use of your Account.

4.3.3 We are not liable for any loss arising from your failure to maintain the security of your credentials.

4.4 Accuracy of Information

4.4.1 You agree to provide accurate, current, and complete information at registration and to update it promptly if it changes.

4.4.2 We reserve the right to suspend or terminate Accounts where information is found to be materially false or misleading.

5. Job Seeker Terms

5.1 Account and Profile Data

5.1.1 A Job Seeker's Account holds: first and last name, profile photo, email address, current location (country where the user is currently based), country of residence (country of permanent residence), date of birth, and gender.

5.1.2 Job Seekers may optionally create a Candidate Profile, which may include: an uploaded CV or résumé (PDF or DOCX format), languages spoken, desired job title and salary expectations, preferred industries and job categories, preferred employment type, portfolio links or work samples, and a personal bio.

5.1.3 Creating a Candidate Profile is entirely voluntary. A Job Seeker may submit Job Applications without one.

5.2 Candidate Profile Visibility

5.2.1 A Candidate Profile is only visible to Employers if the Job Seeker expressly opts in through their Account settings. By enabling this option, the Job Seeker consents to their Candidate Profile being displayed to all registered Employers on the Platform.

5.2.2 On enabling Candidate Profile visibility, the Job Seeker selects how long the profile will remain visible. The available options are 60 days, 90 days, 180 days, or indefinitely until manually deactivated. At the end of the selected period (where applicable), the profile is automatically deactivated. The Job Seeker may deactivate their Candidate Profile at any time through Account settings.

5.2.3 Deactivating the Candidate Profile hides it from all Employers but does not delete the underlying data, which remains securely stored in the Job Seeker's Account. The Candidate Profile can be re-enabled at any time through Account settings. Deactivation does not affect submitted Job Applications or any other Account data.

5.3 Job Applications

5.3.1 When submitting a Job Application, the following data may be shared with the Employer: full profile information (name, date of birth, gender, and profile photo), uploaded CV or résumé, cover letter (if provided), email address and telephone number (where collected as a screening question), salary expectations (where a screening question), responses to the Employer's screening questions, and any additionally requested files.

5.3.2 Job Vacancies may use one of the following application methods, selected by the Employer:

  • Apply on Jobhound — the Job Seeker submits their application through the Platform; Application Data is stored within the Platform's ATS and is accessible to the Employer via the Platform interface.
  • Apply via Email — the Job Seeker submits their application through the Platform in the same manner as above; however, the Application Data is also automatically forwarded to one or more email addresses designated by the Employer. A copy of the application is retained within the Platform's ATS and remains visible to the Employer there.
  • Apply on External Website — the Job Seeker is redirected to an external website operated by the Employer to complete their application. In this case, we do not receive, store, or process Application Data; the application is governed solely by the Employer's own terms and privacy policy. We have no responsibility for the data practices of external websites.

5.3.3 By submitting a Job Application via any platform-based method (Apply on Jobhound or Apply via Email), the Job Seeker acknowledges that their Application Data will be transmitted to and independently processed by the relevant Employer for employment evaluation purposes. The Employer is an independent data controller in respect of the Application Data it receives.

5.3.4 Job Seekers acknowledge that information shared with an Employer may be retained on the Employer's own systems — including email systems for Apply via Email vacancies — over which we have no control.

5.4 Application Data Retention

5.4.1 Job Seekers may control how long their Application Data is stored on the Platform by setting a retention period in their Account settings ("Manage Your Data"). The available options are 60 days, 90 days, 180 days, 365 days, or no automatic expiry. Once the selected period elapses from the date of submission, the Application Data for that application is automatically anonymised in the same manner as upon Account deletion, and the application status changes to "expired". This setting can be updated at any time and applies to all future applications.

5.4.2 The automatic expiry mechanism applies to Application Data stored on the Platform only. It does not affect any data the Employer may have already accessed, downloaded, or retained on their own systems — including any application forwarded by email.

5.5 Application Withdrawal

5.5.1 A Job Seeker may withdraw a submitted Job Application at any time through the Platform interface. Upon withdrawal: the Application is marked as withdrawn within the Platform; the Applicant's personal data is removed from the application record; attached files are deleted; and the application is no longer actively reviewable by the Employer.

5.5.2 Withdrawal does not affect any information the Employer may have already accessed, downloaded, or retained outside the Platform, including any application data forwarded to the Employer by email.

5.6 Application Status

5.6.1 Job Seekers may view the status of submitted Job Applications through their Account dashboard. Statuses include, at minimum: Submitted, In Review, and Declined. Employers may configure additional automated status-change notifications.

5.6.2 We do not guarantee that Employers will update application statuses or respond to all applications.

5.7 AI-Based Vacancy Recommendations and Smart Alerts

5.7.1 The Platform may offer features that automatically analyse a Job Seeker's Candidate Profile, uploaded CV, application history, and stated preferences to identify Job Vacancies on the Platform that appear to be a strong match, including a personalised short-list of recommended vacancies.

5.7.2 Where a Job Seeker has opted in to job alerts (Section 13.2), such alerts may also be personalised on the same basis ("smart alerts") instead of, or in addition to, category-based matching.

5.7.3 Recommendations and smart alerts, where offered, are informational suggestions only. They do not guarantee an interview, a response, or any hiring outcome; they do not affect how the Job Seeker's applications are evaluated by any Employer; and they do not limit the Job Seeker's ability to browse and apply for any vacancy on the Platform.

5.7.4 Where these features are offered, Job Seekers may manage or disable them through Account notification and privacy settings. Details of the personal data processing involved are set out in our Privacy Policy.

6. Employer Terms

6.1 Company Profile

6.1.1 To post Job Vacancies, a user must create a Company Profile. The Company Profile may include: company name, logo, website URL, description, industry category, company size, headquarters and office locations, year founded, social media links, an internal contact number (not publicly displayed), photo and video gallery, a profile banner, and a customisable FAQ section.

6.1.2 The Employer is solely responsible for the accuracy, completeness, and legality of all information in its Company Profile and Job Vacancies.

6.1.3 Company Profile content is publicly visible to all users and visitors unless otherwise specified.

6.1.4 We do not currently operate a mandatory company verification process. We reserve the right to introduce verification requirements and to request supporting documentation at any time.

6.2 Team Members and Roles

6.2.1 An Employer may add multiple team members to a Company Profile. Standard roles include:

  • Owner — highest level of access, including exclusive controls not available to other roles;
  • Administrator — near-equivalent to Owner, with the exception of certain Owner-exclusive functions;
  • Hiring Manager — limited access, restricted to viewing and managing applications for specific Job Vacancies to which access has been granted; and
  • Custom Roles — Employers may create additional roles with configurable permission sets. Permissions on non-Owner/Administrator roles may be modified by the Owner or Administrator.

6.2.2 A single Account may be a team member of multiple Company Profiles simultaneously.

6.2.3 The Employer (acting through its Owner) is responsible for all actions taken by its team members on the Platform. The Employer must promptly remove team members whose access should be revoked.

6.2.4 When a user is added as a team member of a Company Profile, they will receive an email notification.

6.3 Employer Representations and Warranties

6.3.1 By creating or administering a Company Profile, the Employer represents and warrants that:

  • it is a duly established legal entity or a natural person acting in the course of business;
  • all Job Vacancies describe genuine, lawful employment or engagement opportunities;
  • it has the legal right to collect and use Applicant data for the purposes described in each Job Vacancy; and
  • its use of the Platform and the ATS complies with all applicable laws, including the GDPR.

7. Job Vacancies

7.1 Posting Job Vacancies

7.1.1 Job Vacancies (Job Posts) may only be posted using a valid Paid Service subscription plan or prepaid Job Post Credits as described in Section 9. There is no free posting tier.

7.1.2 A Job Vacancy may include: job title, job description, cover image, location (city and country), job category, workplace type (on-site, remote, or hybrid), salary or compensation range (optional), employment type, required experience level, language requirements, application deadline, employee benefits, screening questions (including file upload requirements), Employer-attached documents, and an application method (Apply on Jobhound, Apply via Email, or Apply on External Website).

7.1.3 Employers are responsible for ensuring that each Job Vacancy is accurate, lawful, non-discriminatory, and consistent with applicable employment law in the jurisdiction where the role is located.

7.2 Prohibited Content

7.2.1 The following are strictly prohibited on the Platform:

  • roles that are illegal in the jurisdiction where offered;
  • multi-level marketing (MLM), pyramid schemes, or any structure where earnings depend primarily on recruiting others; and
  • content that is fraudulent, misleading, defamatory, or discriminatory on any protected characteristic.

7.2.2 We reserve the right to reject, remove, or decline to publish any Job Vacancy or other Content at any time, including where it does not technically breach these Terms but is otherwise inconsistent with the Platform's standards or policies.

7.2.3 Recruitment and staffing agencies may post Job Vacancies on behalf of client companies on the same terms as direct Employers, and remain solely responsible for the accuracy and legality of such postings.

7.3 Platform Rights over Job Vacancies

7.3.1 We may: (a) edit listings to correct formatting or categorisation errors; (b) suspend or remove a Job Vacancy that violates these Terms or applicable law; and (c) act on requests from competent authorities.

8. ATS, Application Data, and Data Responsibilities

8.1 ATS Features

8.1.1 The Platform's ATS provides Employers with:

  • a list view of all Applicants per Job Vacancy;
  • customisable hiring stages (for example: Applied → Screened → Interviewed → Offer → Hired / Rejected);
  • internal notes and comments on individual Applicants (not visible to the Applicant);
  • candidate rating and scoring, including AI-Assisted Application Review (Section 8.3);
  • built-in messaging with Applicants;
  • data export (where team members with appropriate access download applicant data); and
  • application sharing with team members holding appropriate permissions.

8.1.2 For Apply via Email vacancies, the ATS retains a copy of each application received, which the Employer can access via the Platform in addition to receiving applications directly by email.

8.2 Independent Data Controllers

8.2.1 Where Job Applications are submitted through the Platform (via Apply on Jobhound or Apply via Email methods), both Jobhound and the Employer independently process Application Data, each as a separate and independent data controller within the meaning of the GDPR:

  • The Employer is a data controller in respect of the Application Data it receives, reviews, and uses to make employment decisions. The Employer determines its own purposes and means for that processing, independently of Jobhound.
  • The Esports Network Limited is a data controller in respect of the processing it carries out on the Platform — including storing, securing, transmitting, and managing Application Data, and operating the AI Features — and independently determines the means and purposes of that processing (including platform operation, security, legal compliance, and analytics).

8.2.2 For Apply via Email vacancies, the Employer additionally independently processes Application Data received via email, outside of the Platform environment, as a data controller for that separate processing activity.

8.2.3 Employers are independently responsible for ensuring that their receipt, use, and further processing of Application Data complies with the GDPR and all applicable data protection laws, including:

  • providing Applicants with a compliant privacy notice covering the Employer's own processing of Application Data;
  • establishing and maintaining a lawful basis for processing; and
  • respecting data subject rights exercised directly with the Employer.

8.2.4 We process Application Data as described in our Privacy Policy and in accordance with our own legal obligations. We are not responsible for the Employer's independent data processing, nor is the Employer responsible for ours.

NOTE ON DATA PROCESSING. Jobhound and the Employer each act as independent data controllers for Application Data processed through the Platform. This reflects standard practice among EU job boards. If your organisation requires a formal Data Processing Agreement with Jobhound for procurement or compliance purposes, please contact [email protected].

8.3 AI-Assisted Application Review

8.3.1 The ATS includes AI-Assisted Application Review: functionality that automatically analyses Application Data against the requirements stated in the relevant Job Vacancy and produces (a) an indicative fit assessment; and (b) an initial sorting of newly received Job Applications into starting folders reflecting indicative match strength.

8.3.2 AI-Assisted Application Review is enabled by default. The Employer may at any time (a) disable the display of fit assessments, and/or (b) disable automatic initial sorting, through the relevant Platform settings.

8.3.3 The output of AI-Assisted Application Review is an advisory, preliminary organisation aid only. It does not reject, decline, shortlist, hire, or advance any Applicant; it does not change any application status; it does not trigger any communication to any Applicant; and it does not hide any Applicant from the Employer — all Applicants remain fully visible and individually reviewable in all folders at all times.

8.3.4 The Employer remains solely responsible for all recruitment decisions. In using the ATS, the Employer must ensure that: (a) before declining or rejecting any Applicant, a human reviewer opens and reviews that Applicant’s application materials; (b) reviewers have the authority and competence to depart from any AI assessment; and (c) no AI assessment is ever the decisive factor in any decision affecting an Applicant. Use of the ATS constitutes acceptance of these conditions.

8.3.5 AI-generated assessments are produced by machine-learning models and may be inaccurate, incomplete, or contextually wrong. We make no warranty as to the accuracy, completeness, or suitability of any AI output, and no AI output constitutes advice or a recommendation by Jobhound in relation to any hiring decision.

8.3.6 For the purposes of Regulation (EU) 2024/1689 (the EU AI Act), The Esports Network Limited acts as the provider, and the Employer acts as the deployer, of the AI-Assisted Application Review functionality.

8.3.7 We may modify, suspend, or discontinue any AI Feature in accordance with Section 3.4. Details of the personal data processing involved in the AI Features are set out in our Privacy Policy.

9. Paid Services

9.1 Overview

9.1.1 Posting a Job Vacancy requires a valid Paid Service subscription plan or prepaid Job Post Credits. The Platform is entirely free for Job Seekers.

9.1.2 Paid Services available to Employers include: Job Post Credits (prepaid credits for individual postings), subscription plans (providing unlimited posting or a defined posting allowance per period), job visibility and promotional features designed to increase the reach and prominence of Job Vacancies, and display advertising products. The specific features, options, and pricing for each Paid Service are as described on the Platform or in a commercial agreement between the Employer and Jobhound.

9.1.3 The range of Paid Services and pricing may be updated from time to time. Changes will be reflected on the Platform. Existing purchased plans will not be affected by price changes during the active plan period.

9.2 Billing and Payment

9.2.1 Online purchases are processed through Stripe (stripe.com). By making a payment you agree to Stripe's terms of service and privacy policy.

9.2.2 Plans arranged via Jobhound's sales team may be invoiced directly by The Esports Network Limited. Payment terms are set out in the relevant commercial agreement or invoice.

9.2.3 All prices are exclusive of VAT unless stated otherwise. VAT will be applied where required by applicable law.

9.3 Refund and Cancellation Policy

9.3.1 Paid Services are non-refundable once delivered or activated, except as set out below or as required by applicable law.

9.3.2 Where we reject a Job Vacancy before publication, the Job Post Credit used for that vacancy will be refunded or reinstated to the Employer's account.

9.3.3 No refund will be issued where a Job Vacancy or Account is removed, suspended, or terminated as a result of a violation of these Terms, including the posting of prohibited or illegal content.

9.3.4 Refund requests in other exceptional circumstances must be submitted to [email protected] and will be reviewed on a case-by-case basis at our sole discretion.

10. Content Standards and Prohibited Conduct

10.1 General Obligations

10.1.1 All users agree not to:

  • post Content that is false, misleading, defamatory, offensive, or unlawful;
  • impersonate any person, company, or entity, or misrepresent your affiliation with any organisation;
  • use the Platform for any purpose other than lawful job searching or hiring;
  • interfere with or disrupt the Platform or its servers or infrastructure;
  • attempt to gain unauthorised access to any part of the Platform or another user's Account;
  • use automated means (bots, scrapers, or crawlers) to extract Content from the Platform without our prior written consent;
  • reverse engineer any part of the Platform; or
  • violate any applicable law or regulation, including data protection and employment law.

10.2 Employer-Specific Obligations

10.2.1 Employers additionally agree to: post only genuine Job Vacancies; avoid discriminatory hiring practices or content; handle Application Data in accordance with applicable data protection law; use AI-Assisted Application Review only in accordance with Section 8.3; comply with the obligations applicable to the Employer as a deployer of AI Features under Regulation (EU) 2024/1689 and follow any instructions for use of the AI Features issued by Jobhound; and respond to reasonable requests from Jobhound to verify the legitimacy of Company Profiles or Job Vacancies.

10.3 Job Seeker-Specific Obligations

10.3.1 Job Seekers additionally agree to: ensure all Account and application information is accurate and honest; not submit Job Applications on behalf of another person without their express consent; and not use the Platform to contact Employers for purposes unrelated to a Job Application.

11. Reporting and Enforcement

11.1 Reporting Violations

11.1.1 Job Seekers may report Job Vacancies or other Content believed to violate these Terms using the reporting mechanism on the Platform. We will review reports but do not commit to a specific response timeframe.

11.2 Enforcement Measures

11.2.1 Where we determine that a user or Content violates these Terms or applicable law, we may, in our sole discretion, apply one or more of the following measures:

  • issue a warning to the relevant user or Employer;
  • remove the specific violating Job Vacancy or Content;
  • suspend all active Job Vacancies associated with an Employer;
  • temporarily suspend an Account;
  • permanently ban an Account; and/or
  • refer the matter to relevant authorities where the Content is or may be illegal.

11.2.2 Enforcement measures are not applied on a mandatory escalation basis. We may apply any measure, including permanent ban, immediately where we consider the breach sufficiently serious.

11.2.3 Where an Employer Account is permanently banned, all of the Employer's active Job Vacancies will be unpublished by the Jobhound team. Individual Applicants are not separately notified of the unpublishing of a vacancy.

11.2.4 Where a Job Vacancy or Account is removed or banned for breach of these Terms, no refund of Paid Services will be issued.

12. Intellectual Property

12.1 All intellectual property rights in and to the Platform — including its design, software, databases, trade marks, and all Content created by us — are owned by or licensed to The Esports Network Limited. "Jobhound" is a trading and brand name used by The Esports Network Limited. Nothing in these Terms transfers any intellectual property rights to users.

12.2 Job Seekers and Employers retain ownership of the Content they submit to the Platform. By submitting Content, you grant The Esports Network Limited a worldwide, non-exclusive, royalty-free licence to:

  • host, display, store, and reproduce your Content for the purposes of operating and improving the Platform; and
  • promote Job Vacancies — including the job title, description, Employer name, location, and other posting details — on third-party platforms, social media channels, external job boards and aggregators, and partner sites, for the purpose of attracting candidates to those vacancies.

12.3 The promotional licence in clause 12.2 applies automatically when an Employer publishes a Job Vacancy on the Platform. The Employer acknowledges that vacancy details may be distributed externally as part of Jobhound's standard promotion activity.

12.4 Our licence to your Content does not extend to uses beyond Platform operation and vacancy promotion without your separate consent.

12.5 You represent and warrant that: (a) you own or have the right to submit all Content you provide; and (b) your Content does not infringe the intellectual property or other rights of any third party.

13. Communications and Notifications

13.1 Transactional Communications

13.1.1 We send transactional communications necessary for Platform operation, including: registration confirmation; Job Application confirmation notifications (where enabled by the Employer); new application alerts to Employers (where enabled); "application viewed" notifications to Job Seekers; application status update notifications (where the Employer has configured automated notifications); chat and message notifications; company team membership notifications; password reset emails; billing and invoice notifications to Employers; and Platform update announcements.

13.1.2 Transactional communications are essential to delivering the service. You cannot opt out of transactional communications while maintaining an active Account.

13.2 Job Alerts

13.2.1 Job Seekers may opt in to job recommendation emails and vacancy alerts for companies they follow. Where offered, such alerts may also be personalised based on the Job Seeker's Candidate Profile, CV, and preferences ("smart alerts" — see Section 5.7). You may opt out at any time through Account notification settings.

13.3 Marketing Communications to Employers

13.3.1 We may send marketing communications by email to Employers whose contact details we obtained in the context of the sale or provision of our services to them, in relation to our own similar services (including information about new features, offers, and platform news). You may opt out free of charge at any time, including at the point where we collect your contact details, and every such email contains an unsubscribe link.

13.3.2 You may opt out at any time by using the unsubscribe link in any marketing email or by contacting [email protected].

14. Account Deactivation, Deletion, and Data Lifecycle

14.1 Job Seeker Account Deletion

14.1.1 A Job Seeker may delete their Account at any time through Account settings. The following automated process is applied immediately upon deletion request:

  • The Candidate Profile (if any) is permanently and irreversibly deleted.
  • All submitted Job Applications are anonymised: personal data fields are cleared, attached files are deleted, and a "deleted user" flag is applied to the record. Chat threads with Employers are archived and set to read-only; chat messages and notifications are permanently deleted.
  • All Company Profile memberships are permanently removed.
  • The Account record is anonymised: name, email address, profile photo, location, date of birth, gender, and linked OAuth credentials are removed and replaced with non-identifiable system values. The anonymised record is not identifiable as belonging to any individual.
  • All active access tokens and OAuth connections (Google, LinkedIn, Facebook) are permanently deleted.

14.1.2 Anonymised application records are retained for the minimum period required by applicable law or for aggregated internal operational analytics. No personal data is retained following the deletion process above.

14.1.3 We cannot control or require deletion of Application Data already accessed, downloaded, or retained by an Employer on their own systems — including application data previously forwarded by email — prior to the deletion request.

14.2 Employer Company Profile Deactivation

14.2.1 An Employer may request deactivation of its Company Profile by contacting [email protected].

14.2.2 Upon deactivation, the Company Profile is suspended: the Employer may no longer post new Job Vacancies or add new team members. Existing Job Vacancies and their associated Application Data are not deleted and remain accessible to team members with existing access until that access is separately revoked.

14.2.3 Deactivation does not delete Account records, existing Job Vacancies, or Application Data stored on the Platform. We retain this data in accordance with our Privacy Policy.

14.2.4 If the Employer requires a data export before deactivation, this must be requested in advance. We are not obligated to provide data access after deactivation unless required by law.

14.3 Data Export (GDPR Portability)

14.3.1 Users wishing to obtain a copy of their personal data held by us (under GDPR Article 20) may submit a request to [email protected]. We will respond within one month of receiving a valid request (extendable where the law allows for complex requests).

15. Limitation of Liability

15.1 To the maximum extent permitted by applicable law, The Esports Network Limited shall not be liable for: indirect, incidental, special, consequential, or punitive damages; loss of profits, revenue, business, or goodwill; loss or corruption of data; the conduct or content of any other user of the Platform; or any recruitment or employment outcome or absence thereof.

15.2 Our total aggregate liability to any user for direct damages shall not exceed the greater of: (a) the amount paid by that user to us in the 12 months preceding the claim; or (b) EUR 500.

15.3 Nothing in these Terms limits or excludes liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be excluded under applicable law.

15.4 Nothing in this Section 15 limits or excludes any right of a user acting as a consumer that cannot be limited or excluded under applicable law, including any right to compensation under applicable data protection law.

16. Disclaimer of Warranties

16.1 The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including as to fitness for purpose, uninterrupted operation, or freedom from errors or defects.

16.2 We do not warrant that: Job Vacancies are accurate, current, or genuine; Employers will respond to or review all applications; use of the Platform will result in employment for any Job Seeker or a successful hire for any Employer; AI Features will produce accurate or complete outputs; or the Platform will be available at all times without interruption.

16.3 Nothing in this Section 16 affects the statutory rights of users acting as consumers, which cannot be excluded or limited.

17. Third-Party Links and Services

17.1 The Platform may contain links to external websites, including Employer career pages and external application portals. We are not responsible for the content, accuracy, or data practices of any external website. Your use of third-party websites is at your own risk and governed by their terms and privacy policies.

17.2 Where Job Vacancies direct applicants to an external URL for application submission, we are not party to any data exchange that occurs through that process.

18. Changes to These Terms

18.1 We may update these Terms for valid reasons, including changes in law or regulation, security requirements, changes to Platform features, or changes to Paid Services and pricing for Employers. For material changes, we will notify registered users by email and/or present the updated Terms for review and acceptance when they next access the Platform. Minor or administrative changes (such as corrections, clarifications, or updates to contact details) may be made without notice.

18.2 Material changes bind you upon your acceptance of the updated Terms. For minor or administrative changes only, your continued use of the Platform after publication constitutes your agreement to the revised Terms. If you do not accept the changes, you must cease using the Platform; you may delete your Account at any time, and may request an export of your data (Section 14.3), regardless of acceptance.

18.3 The current version of these Terms is always available on the Platform.

19. Governing Law and Dispute Resolution

19.1 These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Malta.

19.2 The courts of Malta shall have jurisdiction to settle any such dispute, subject to any mandatory rights you hold under the law of your country of habitual residence.

19.3 We prefer to resolve disputes informally in the first instance. If you have a complaint, please contact [email protected] before initiating formal proceedings.
